1. Introduction

Welcome to Pladio. These Terms of Service ("Terms") govern your use of:

  • The Pladio website at pladio.app and all subdomains ("Website")
  • The Pladio applications for iOS, iPadOS, macOS, tvOS, watchOS, and CarPlay (collectively, the "App")
  • All related services and features ("Services")

Pladio is operated by Patrick Diezi / KREANIQS ("Pladio", "I," "me", or "my").

By accessing the Website, downloading the App, or using any Services, you agree to be bound by these Terms. If you do not agree, please do not use Pladio.

2. Scope of These Terms

2.1 Comprehensive Coverage

These Terms apply to:

Website Use:

  • Browsing information pages
  • Reading blog posts and articles
  • Viewing documentation
  • Accessing support resources
  • Downloading the App

App Use (All Supported Platforms):

  • Installing and using the Pladio App on your iPhone, iPad, Mac, Apple TV, and Apple Watch
  • Streaming radio stations
  • Using song recognition features (iOS, macOS)
  • Accessing Premium features (if purchased)
  • Syncing data via iCloud
  • Using Pladio widgets, complications, Siri Shortcuts, and Top Shelf content
  • Controlling playback from Apple Watch via WatchConnectivity

Services:

  • All features and functionality provided through the Website, App, and the Pladio cloud radio station database hosted at api.pladio.app

2.2 Additional Documents

These Terms incorporate by reference:

  • Privacy Policy (https://www.pladio.app/privacy) — Describes data collection and use
  • End User License Agreement (EULA) — Provides additional terms for App licensing

In case of conflict between these Terms and other documents, these Terms shall prevail.

2.3 Apple's Terms

Use of the App through Apple's App Store is also subject to Apple's App Store Terms of Service. Apple is not a party to these Terms.

3. Eligibility and Account

3.1 Age Requirement

You must be at least 13 years old to use Pladio. If you are under 18, you must have parental or guardian consent.

For users under 13: Pladio is not directed to children under 13. I do not knowingly collect information from children under 13.

3.2 No Account Required

Pladio does not currently require account creation. You can use the App and Website without registering.

3.3 Future Account Features

If I introduce account features in the future:

  • You will be responsible for maintaining account security
  • You must provide accurate information
  • You may not share accounts
  • I may suspend or terminate accounts that violate these Terms

4. License Grant

4.1 Website License

I grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes.

4.2 App License

I grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on devices you own or control
  • Use the App for personal, non-commercial purposes
  • Access features and services provided through the App on any supported Apple platform (iOS, iPadOS, macOS, tvOS, watchOS, CarPlay)

4.3 License Restrictions

You may NOT:

  • Distribute or Share: Redistribute, sell, rent, lease, or sublicense the App or Website content
  • Modify: Reverse engineer, decompile, disassemble, or attempt to derive source code
  • Copy: Make unauthorized copies
  • Commercial Use: Use for commercial purposes without written permission
  • Remove Notices: Remove or alter copyright, trademark, or proprietary notices
  • Circumvent: Bypass, disable, or interfere with security features or usage limits (including the cloud radio station database rate limits)
  • Automate: Use scripts, bots, or automated tools without permission
  • Harm: Transmit malware, spam, or harmful content

5. Acceptable Use

5.1 Lawful Use Only

You agree to use Pladio in accordance with all applicable laws and regulations.

5.2 Prohibited Activities

You may NOT:

  • Violate any local, national, or international law
  • Infringe intellectual property rights
  • Transmit harmful or malicious code
  • Harass, abuse, or harm others
  • Collect personal information without consent
  • Impersonate others or misrepresent affiliation
  • Interfere with or disrupt Pladio, its servers, or the Pladio cloud infrastructure
  • Access content unavailable in your geographic region through technical circumvention
  • Use Pladio to distribute spam or unsolicited communications
  • Attempt unauthorized access to systems or data
  • Abuse the Pladio cloud radio station database, including through excessive automated requests

5.3 Enforcement

I reserve the right to investigate violations and take appropriate action, including:

  • Removing content
  • Suspending or terminating access
  • Rate-limiting or blocking access to api.pladio.app
  • Reporting to law enforcement
  • Taking legal action

6. Radio Content and Third-Party Services

6.1 Third-Party Radio Streams

The App provides access to third-party radio streams. I do not control, operate, or endorse radio stations or their content.

Disclaimer:

  • Content accuracy and quality are not guaranteed
  • Stream availability and uptime are outside my control
  • Radio stations are responsible for copyright compliance

Your Responsibility: You are responsible for ensuring your use of radio content complies with applicable laws in your jurisdiction.

6.2 Third-Party Service Integration

Pladio integrates with third-party services. Availability varies by platform (see Privacy Policy for platform-specific details):

Song Recognition (iOS, macOS):

  • ACRCloud (audio fingerprinting)

Music Services:

  • Apple Music API (metadata and library integration)

Lyrics (iOS, macOS):

  • MusixMatch (song lyrics)

Data Sync:

  • Apple iCloud (favorites, history, manual stations, and settings sync)

Subscription Management:

  • Apple StoreKit 2 (in-app purchases and subscriptions). Pladio does not use any third-party subscription management provider.

Analytics (optional, not used on watchOS in this version):

  • PostHog

Cloud Infrastructure (operated by me):

  • Cloudflare Workers (API gateway at api.pladio.app)
  • Supabase (radio station catalog, eu-central-1)

Third-Party Terms: Use of these services is subject to their respective terms and privacy policies. I am not responsible for third-party service availability, functionality, or policies.

6.3 Apple Music

Use of Apple Music features requires an Apple Music subscription or Apple Music free tier. I am not responsible for Apple Music availability, terms, pricing, or content.

6.4 Internet Connection

Pladio requires an active internet connection for most features. You are responsible for obtaining and maintaining internet access and associated costs.

7. Premium Features and Subscriptions

7.1 Free Features

Core radio streaming features are free and will remain free, including:

  • Radio station streaming
  • Stream metadata-based song recognition
  • Audio fingerprinting song recognition (with rate limits, iOS and macOS)
  • Favorites, recents, and manual stations
  • iCloud sync of favorites, recents, manual stations, and settings
  • CarPlay support
  • Home Screen and Lock Screen widgets (iOS, macOS)
  • CarPlay widgets
  • Siri Shortcuts and App Intents
  • Dynamic Island and Now Playing integration
  • Spotlight search and Focus Filters
  • Mute control
  • Sleep timer (with fallback presets 20/40/60 minutes)

7.2 Premium Features

I offer Premium features through in-app purchases and subscriptions. In v1.4, Premium features include:

  • Apple TV App
  • Apple Watch App
  • Audio Equalizer (5-band EQ with presets, per-station memory, loudness normalization)
  • In-App Volume Control
  • Sleep Timer Presets (custom presets, auto-activation, quick extend)
  • Station Alarm (iOS and Apple Watch)

Growing Value Model: Price stays constant, subscribers automatically receive new Premium features added in future versions.

Availability: Premium features are subject to change. I may add, modify, or remove features at my discretion.

7.3 Pricing and Payment

Pricing:

  • Displayed in your local currency
  • Subject to change with notice
  • Includes applicable taxes where required

Payment Processing:

  • All payments processed through Apple's App Store
  • Payment information handled exclusively by Apple
  • I do not have access to your payment details

Subscriptions:

  • Auto-renew until canceled
  • Charged to your Apple account
  • Renew 24 hours before period ends
  • Manage through Apple account settings

7.4 Subscription Management

Subscriptions are managed natively through Apple StoreKit 2:

  • All purchase and subscription transactions are handled exclusively by Apple
  • Subscription entitlements are synchronized across your Apple devices via your iCloud account
  • Pladio does not use any third-party subscription management provider (such as RevenueCat)
  • I receive only anonymized subscription status from Apple

7.5 Cancellation and Refunds

Cancellation:

  • Cancel anytime through Apple account settings
  • Cancellation effective at end of current billing period
  • No refunds for partial periods

Refunds:

  • Subject to Apple's refund policy
  • Request refunds through Apple
  • I do not control Apple's refund decisions

7.6 Free Trials

If I offer free trials:

  • Available to new subscribers only
  • Automatically convert to paid unless canceled
  • Cancel before trial ends to avoid charges
  • One trial per user

7.7 Price Changes

I may change Premium pricing with 30 days' notice. Changes apply:

  • Immediately for new subscribers
  • At next renewal for existing subscribers
  • You may cancel before renewal to avoid new price

8. Intellectual Property

8.1 My Ownership

All content and materials in Pladio, including:

  • App source code and design
  • Website content and design
  • Text, graphics, logos, images
  • Audio processing algorithms
  • Trademarks and brand elements
  • Documentation and tutorials
  • The Pladio cloud radio station catalog and its curation

…are owned by me or my licensors and protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Your Content

Favorites and Preferences

You retain rights to your selections and preferences. However, such data consists only of references and identifiers and does not constitute copyrightable content.

Manual Radio Stations

You retain rights to the URLs and metadata you add as manual stations. You are solely responsible for ensuring you have the right to stream any URLs you add.

Feedback

If you provide feedback, suggestions, or ideas about Pladio ("Feedback"), you grant me a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate such Feedback without compensation or attribution.

8.3 Limited License to Website Content

You may:

  • View and print pages for personal use
  • Share links to Website content
  • Quote brief excerpts with proper attribution

You may NOT:

  • Reproduce substantial portions without permission
  • Create derivative works
  • Use for commercial purposes without authorization
  • Remove attribution or copyright notices

8.4 Trademarks

"Pladio" and associated logos are trademarks of Patrick Diezi / KREANIQS. You may not use my trademarks without prior written permission.

8.5 Open Source Software

The App may include open-source software components, each subject to its own license terms. Such licenses are available within the App (Settings → Open Source Licenses).

9. Privacy and Data Protection

9.1 Privacy Policy

My collection, use, and protection of your personal data is governed by my Privacy Policy at https://www.pladio.app/privacy.

Key Points:

  • Minimal data collection
  • No selling of personal data
  • iCloud sync for favorites, history, manual stations, and settings
  • Optional analytics (can be disabled; not used on watchOS in this version)
  • Subscription management via Apple StoreKit 2 only
  • Cloud radio station database hosted on Cloudflare Workers + Supabase (eu-central-1)
  • GDPR and Swiss DPA compliant

9.2 Data Collection

Automatically Collected:

  • Device information (type, OS version)
  • App version and platform
  • Crash and diagnostic data (via Apple, optional)
  • Subscription status (via Apple StoreKit 2)

With Your Consent:

  • Usage analytics (via PostHog; iOS, macOS, tvOS only)
  • Approximate location (for local station filtering, iOS and macOS only)

Temporary:

  • Audio samples for song recognition (immediately deleted, iOS and macOS only)

9.3 Your Rights

You have the right to:

  • Access your data
  • Correct inaccurate data
  • Request deletion
  • Object to processing
  • Data portability
  • Withdraw consent

9.4 Cookies (Website Only)

  • Essential Cookies: Required for Website functionality
  • Analytics Cookies: Optional, help improve user experience
  • Cookie Control: Manage through browser settings

10. Updates and Modifications

10.1 App Updates

I may release updates, upgrades, patches, or new versions:

  • Add, modify, or remove features
  • Change functionality or appearance
  • Fix bugs and security vulnerabilities

Your Responsibility: You are responsible for obtaining and installing updates. Failure to update may result in security vulnerabilities or degraded functionality.

Automatic Updates: If enabled, the App may automatically download and install updates through your device settings.

10.2 Website Changes

I may modify the Website:

  • Update content without notice
  • Change design or functionality
  • Add or remove features
  • Temporarily suspend for maintenance

10.3 Cloud Service Changes

I may update or modify the Pladio cloud radio station database and API endpoints (api.pladio.app) at any time, including changes to the station catalog, caching behavior, or rate limits.

10.4 No Obligation

I am not obligated to provide updates or maintain services but may do so at my discretion.

11. Disclaimers and Warranties

11.1 "AS IS" Provision

PLADIO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

I DISCLAIM ALL WARRANTIES, INCLUDING:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content
  • Uninterrupted or error-free operation
  • Security or freedom from viruses or harmful components

11.2 No Guarantee of Availability

I do not guarantee that:

  • Pladio will be available at all times
  • The App will function on all devices
  • Radio streams will be accessible
  • Third-party services will remain available
  • Features will remain unchanged
  • Premium features will function without interruption
  • The Pladio cloud radio station database will be continuously available

11.3 Information Accuracy

While I strive for accuracy, I do not warrant that:

  • Content is accurate, current, or complete
  • Information will be free from errors or omissions
  • Information will meet your specific needs

11.4 No Professional Advice

Information in Pladio is for general informational purposes only and does not constitute professional advice of any kind.

11.5 Beta Features

Pladio may include beta or experimental features provided for testing purposes and may not function as intended.

11.6 Third-Party Limitations

Radio streaming depends on:

  • Radio station operation (outside my control)
  • Your internet connection
  • Third-party infrastructure

I am not responsible for stream interruptions, quality issues, or unavailability.

12. Limitation of Liability

12.1 Maximum Extent Permitted by Law

TO THE MAXIMUM EXTENT PERMITTED BY LAW, I SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF PLADIO.

12.2 Types of Damages Excluded

Indirect Damages:

  • Loss of profits or revenue
  • Loss of data or information
  • Loss of business opportunities
  • Reputational damage

Consequential Damages:

  • Damages from use or inability to use Pladio
  • Unauthorized access to your data
  • Third-party actions or content
  • Subscription processing failures
  • Failure or disruption of the Pladio cloud radio station database

Direct Damages:

My total liability shall not exceed the amount you paid me in the 12 months preceding the claim, or $50 USD, whichever is greater.

12.3 Third-Party Liability

I am not liable for:

  • Radio station content or actions
  • Third-party service failures (ACRCloud, Apple Music, MusixMatch, PostHog, Cloudflare, Supabase, etc.)
  • Apple's In-App Purchase processing and StoreKit 2 service availability
  • Copyright infringement by radio stations

12.4 Jurisdictional Limitations

Some jurisdictions do not allow exclusion or limitation of certain warranties or damages. In such cases, my liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless me, my affiliates, officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of Pladio
  • Your violation of these Terms
  • Your violation of applicable laws
  • Your violation of third-party rights
  • Content you access or share through Pladio
  • Your subscription or purchase transactions
  • Manual stations you add to your library

14. Copyright and DMCA

14.1 Copyright Policy

I respect intellectual property rights. If you believe content in Pladio infringes your copyright, contact me.

14.2 DMCA Notices (US Users)

For copyright infringement claims under the US Digital Millennium Copyright Act (DMCA), provide:

  1. Physical or electronic signature of copyright owner or authorized representative
  2. Identification of the copyrighted work
  3. Identification of the infringing material and its location
  4. Your contact information
  5. Statement of good faith belief
  6. Statement of accuracy and authority

14.3 Counter-Notices

If content was removed due to a DMCA notice, you may file a counter-notice under DMCA procedures.

14.4 Repeat Infringers

I may terminate access for users who are repeat copyright infringers.

15. Term and Termination

15.1 Term

These Terms begin when you first use Pladio and continue until terminated.

15.2 Termination by You

You may stop using Pladio at any time by:

  • Deleting the App from your devices
  • Ceasing Website use
  • Canceling active subscriptions

15.3 Termination by Me

I may suspend or terminate your access immediately, without notice, if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • I discontinue Pladio
  • Required by law

15.4 Effect of Termination

Upon termination:

  • Your license to use Pladio ends immediately
  • You must delete the App from all devices
  • Active subscriptions continue until expiration (no refunds)
  • Provisions that should survive (disclaimers, limitations, indemnification) remain in effect
  • Your data may be deleted from iCloud (at your discretion)

16. Changes to These Terms

16.1 Right to Modify

I may modify these Terms at any time. Changes are effective:

  • 30 days after notice for material changes
  • Immediately for non-material changes

16.2 Notice of Changes

I will notify you by:

  • In-app notification (if using App)
  • Prominent notice on Website
  • Updated "Last Updated" date

16.3 Continued Use

Your continued use of Pladio after changes constitutes acceptance. If you do not agree, stop using Pladio.

17. Dispute Resolution

17.1 Informal Resolution

Before formal proceedings, attempt to resolve disputes informally by contacting me at [email protected].

17.2 Mediation

If informal resolution fails, parties agree to attempt mediation before litigation.

17.3 Arbitration (Where Applicable)

Disputes may be resolved through binding arbitration in accordance with Swiss arbitration rules, except where prohibited by law.

17.4 Class Action Waiver

To the extent permitted by law, you agree to bring claims only in an individual capacity, not as part of a class action.

18. Governing Law and Jurisdiction

18.1 Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.

18.2 Jurisdiction

Disputes shall be resolved in the courts of Frauenfeld, Switzerland.

18.3 EU Users

For users in the European Union:

  • Nothing affects your statutory rights under EU consumer protection laws
  • You may bring claims in your local courts
  • EU consumer protection laws apply where more favorable

18.4 UK Users

For users in the United Kingdom:

  • UK consumer protection laws apply
  • Nothing affects your statutory rights
  • You may bring claims in your local courts

18.5 California Users

California residents are entitled to specific consumer rights under California law. Nothing in these Terms waives those rights.

19. Apple-Specific Terms

19.1 Acknowledgment

You acknowledge that:

  • These Terms are between you and me, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide maintenance or support
  • Apple is not responsible for warranty claims
  • Apple is not responsible for product liability claims
  • Apple is not responsible for intellectual property infringement claims
  • Apple processes in-app purchases via StoreKit 2 but is not responsible for subscription management beyond payment processing

19.2 Third-Party Beneficiary

Apple is a third-party beneficiary of these Terms and may enforce them against you.

19.3 Contact Apple

For App Store-related issues, contact Apple Support.

20. General Provisions

20.1 Entire Agreement

These Terms, together with the Privacy Policy and EULA, constitute the entire agreement between you and me regarding Pladio.

20.2 Severability

If any provision is invalid or unenforceable, the remaining provisions remain in full force and effect.

20.3 Waiver

My failure to enforce any provision does not constitute a waiver.

20.4 Assignment

You may not assign or transfer these Terms. I may assign to an affiliate or successor without your consent.

20.5 No Third-Party Beneficiaries

These Terms do not confer rights upon third parties, except as expressly stated (e.g., Apple's rights).

20.6 Force Majeure

I am not liable for failure to perform due to circumstances beyond my reasonable control (natural disasters, wars, strikes, government actions, pandemics, internet outages, cloud provider failures).

20.7 Export Compliance

You agree to comply with all export and import laws when using Pladio.

20.8 U.S. Government Rights

If you are a U.S. government entity, the App is "commercial computer software" as defined in FAR 12.212 and DFARS 227.7202.

20.9 Language

The English version of these Terms shall prevail in case of conflicts with translations.

22. Acknowledgment

BY USING PLADIO (WEBSITE OR APP), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
