Agreement to Terms

This End User License Agreement ("Agreement") is a legal agreement between you ("User", "you", or "your") and me (Patrick Diezi / KREANIQS) ("I", "me", or "my") for the use of the Pladio software applications (collectively, the "App"), including all updates, upgrades, and related services.

The App includes builds for iOS, iPadOS, macOS, tvOS, watchOS, and CarPlay.

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree to these terms, do not download, install, or use the App.


1. License Grant

1.1 Scope of License

Subject to your compliance with this Agreement, I grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on Apple devices you own or control (iPhone, iPad, Mac, Apple TV, Apple Watch)
  • Use the App for personal, non-commercial purposes
  • Access features and services provided through the App on any supported Apple platform
  • Use the Pladio CarPlay integration in a vehicle that supports CarPlay

1.2 License Restrictions

You may NOT:

  • Distribute or Share: Redistribute, sell, rent, lease, or sublicense the App
  • Modify: Reverse engineer, decompile, disassemble, or attempt to derive source code
  • Copy: Make copies of the App except for backup purposes
  • Commercial Use: Use the App for commercial purposes without written permission
  • Remove Notices: Remove or alter any copyright, trademark, or proprietary notices
  • Circumvent: Bypass, disable, or interfere with security features or usage limits (including the Pladio cloud API rate limits)
  • Automate: Use scripts, bots, or automated tools to access the App or the Pladio cloud radio station database
  • Harm: Use the App to transmit malware, spam, or harmful content

1.3 Apple App Store Terms

This Agreement is between you and me, not Apple Inc. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for any claims, losses, damages, or liabilities related to the App.

In the event of any conflict between this Agreement and Apple's App Store Terms of Service, Apple's terms shall prevail with respect to your use of the App Store.


2. Ownership and Intellectual Property

2.1 My Ownership

The App, including all content, features, functionality, source code, designs, graphics, text, trademarks, and the Pladio cloud radio station catalog, is owned by me or my licensors and is protected by:

  • Copyright laws
  • Trademark laws
  • Patent laws
  • Trade secret laws
  • International intellectual property treaties

2.2 Your Content

Radio Station Favorites and Preferences

You retain all rights to the selections and preferences you create within the App. However, such data is limited to references and identifiers and does not constitute copyrightable content.

Manual Radio Stations

You retain rights to the URLs and metadata you add as manual stations (up to 15 per iCloud account). You are solely responsible for ensuring you have the right to stream any URLs you add to the App.

2.3 Feedback

If you provide feedback, suggestions, or ideas about the App ("Feedback"), you grant me a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate such Feedback into the App without compensation or attribution.


3. Use of the App

3.1 Acceptable Use

You agree to use the App in accordance with all applicable laws and regulations and only for lawful purposes.

Prohibited Uses

You may NOT use the App to:

  • Violate any local, national, or international law
  • Infringe intellectual property rights
  • Transmit harmful or malicious code
  • Harass, abuse, or harm others
  • Collect personal information without consent
  • Impersonate others or misrepresent affiliation
  • Interfere with or disrupt the App, its servers, or the Pladio cloud infrastructure (api.pladio.app)
  • Access content unavailable in your geographic region through technical circumvention
  • Abuse the Pladio cloud radio station database through excessive or automated requests

3.2 Third-Party Content

The App provides access to third-party radio streams and content. I do not control, endorse, or assume responsibility for such content. Use of third-party content is at your own risk.

3.3 Internet Connection

The App requires an active internet connection to stream radio and, on supported platforms, to receive station catalog updates from the Pladio cloud radio station database. You are responsible for obtaining and maintaining internet access and any associated costs.


4. Updates and Modifications

4.1 App Updates

I may from time to time:

  • Release updates, upgrades, patches, or new versions
  • Add, modify, or remove features
  • Change the App's functionality or appearance
  • Update the Pladio cloud radio station database and its API

Your Responsibility

You are responsible for obtaining and installing updates. Failure to update may result in security vulnerabilities or degraded functionality.

4.2 Automatic Updates

If enabled, the App may automatically download and install updates. You can disable automatic updates through your device settings.

4.3 No Obligation to Update

I am not obligated to provide updates, support, or maintenance but may do so at my discretion.


5. Third-Party Services

5.1 Integration with Third-Party Services

The App integrates with third-party services. Availability varies by platform (see Privacy Policy for platform-specific details):

  • ACRCloud (song recognition via audio fingerprinting — iOS and macOS only)
  • Apple Music (metadata and library integration — iOS, macOS, watchOS)
  • Apple iCloud (data synchronization — all platforms)
  • MusixMatch (lyrics — iOS and macOS only)
  • Apple StoreKit 2 (in-app purchases and subscription management — all platforms)
  • PostHog (analytics — iOS, macOS, tvOS; not used on watchOS)
  • Cloudflare Workers (API gateway for api.pladio.app — all platforms, operated by me)
  • Supabase (cloud radio station database, eu-central-1 — all platforms, operated by me)

Third-Party Terms

Use of these services is subject to their respective terms and privacy policies. I am not responsible for third-party services or their availability.

5.2 Radio Station Content

Radio stations accessible through the App are operated by independent third parties. I do not control, endorse, or guarantee:

  • Content accuracy or quality
  • Stream availability or uptime
  • Compliance with copyright or broadcasting laws

Your Responsibility

You are responsible for ensuring your use of radio content complies with applicable laws in your jurisdiction.

5.3 Apple Music Integration

Use of Apple Music features requires an Apple Music subscription or Apple Music free tier. I am not responsible for Apple Music availability, terms, or pricing.

5.4 Subscription Management via StoreKit 2

In-app purchases and subscriptions are managed natively through Apple StoreKit 2. Apple processes payments and handles all subscription logic. Pladio does not use any third-party subscription management provider (such as RevenueCat). I receive only anonymized subscription status from Apple; no payment information is shared with me.

5.5 Cloud Radio Station Database

Since v1.4, Pladio delivers its radio station catalog from a cloud backend (Cloudflare Workers proxying Supabase at eu-central-1), accessible via api.pladio.app. This backend is operated by me. Queries to this backend contain radio-station-related parameters only and do not include personal identifiers.


6. Premium Features

6.1 In-App Purchases

I offer Premium features through in-app purchases or subscriptions ("Premium Features"). Premium Features are processed through Apple's App Store using StoreKit 2.

In v1.4, Premium Features include:

  • Apple TV App
  • Apple Watch App
  • Audio Equalizer (5-band EQ with presets, per-station memory, loudness normalization)
  • In-App Volume Control
  • Sleep Timer Presets (custom presets, auto-activation, quick extend)
  • Station Alarm (iOS and Apple Watch)

Growing Value Model: Price stays constant, subscribers automatically receive new Premium features added in future versions.

6.2 Pricing and Payment

  • Prices are displayed in your local currency
  • Payment processed through Apple's App Store
  • Payment information is handled exclusively by Apple
  • Subscriptions auto-renew unless canceled
  • Refunds subject to Apple's refund policy

6.3 Subscription Terms

When you purchase a subscription:

  • You grant authorization for recurring charges
  • Subscription automatically renews until canceled
  • You can cancel anytime through your Apple account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial subscription periods (subject to Apple's refund policy)
  • Premium entitlements are synchronized across your Apple devices via your iCloud account

6.4 Free Tier Commitment

Core radio streaming features will remain free indefinitely, even after Premium Features are available.


7. Privacy and Data Protection

7.1 Privacy Policy

My collection, use, and protection of your personal data is governed by my Privacy Policy, available at https://www.pladio.app/privacy or within the App.

By using the App, you acknowledge that you have read and understood my Privacy Policy.

7.2 Data Storage

  • Favorites, history, manual stations, and settings are stored via iCloud Key-Value Storage
  • User preferences are also stored locally on your device
  • Audio samples for song recognition (iOS and macOS only) are temporary and immediately deleted after identification
  • Subscription status is delivered by Apple StoreKit 2 and cached locally
  • Radio station catalog is fetched on demand from the Pladio cloud (Cloudflare Workers + Supabase)

7.3 Analytics (Optional)

If you consent, I collect anonymized usage data to improve the App (iOS, macOS, and tvOS only — not used on watchOS in this version). You can disable analytics in Settings → Privacy.

For financial control of third-party paid services, requests to ACRCloud and MusixMatch are always logged anonymously to PostHog.

7.4 Subscription Data

Subscription transactions are handled exclusively by Apple via StoreKit 2. I do not store, log, or share purchase details with any third party. No third-party subscription management provider is used.


8. Disclaimers and Limitations

8.1 "AS IS" and "AS AVAILABLE"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content
  • Uninterrupted or error-free operation
  • Freedom from viruses or harmful components

8.2 No Guarantee of Availability

I do not guarantee that:

  • The App will be available at all times
  • The App will function on all devices
  • Radio streams will be accessible
  • Third-party services will remain available
  • Features will remain unchanged
  • Premium features will function without interruption
  • The Pladio cloud radio station database will be continuously available

8.3 Beta Features

The App may include beta or experimental features. Such features are provided for testing purposes and may not function as intended.

8.4 Internet Radio Limitations

Internet radio streaming depends on:

  • Radio station operation (outside my control)
  • Your internet connection
  • Third-party streaming infrastructure

I am not responsible for stream interruptions, quality issues, or unavailability.

8.5 Subscription Service Limitations

Premium features depend on:

  • Apple's In-App Purchase infrastructure (StoreKit 2)
  • Proper network connectivity

I am not responsible for subscription processing failures, delays, or service interruptions caused by Apple.

8.6 Cloud Service Limitations

The Pladio cloud radio station database depends on:

  • Cloudflare Workers (API gateway)
  • Supabase (database, eu-central-1)
  • Your internet connection

I am not responsible for outages, latency, or service interruptions caused by these providers. The App includes local caching to mitigate short interruptions.


9. Limitation of Liability

9.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL I BE LIABLE FOR:

Indirect Damages

  • Loss of profits
  • Loss of data
  • Loss of business opportunities
  • Reputational harm

Consequential Damages

  • Damages resulting from use or inability to use the App
  • Unauthorized access to your data
  • Statements or conduct of third parties
  • Third-party content or services
  • Subscription processing failures or delays
  • Cloud radio station database outages

Direct Damages

My total liability shall not exceed the amount you paid me in the 12 months preceding the claim, or $50 USD, whichever is greater.

9.2 Jurisdiction-Specific Limitations

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability. In such jurisdictions, my liability is limited to the maximum extent permitted by law.

9.3 No Liability for Third Parties

I am not liable for:

  • Actions or omissions of radio stations
  • Third-party service failures (ACRCloud, Apple Music, MusixMatch, PostHog, Cloudflare, Supabase, etc.)
  • Content broadcast by radio stations
  • Copyright infringement by radio stations
  • Apple's In-App Purchase processing

10. Indemnification

You agree to indemnify, defend, and hold harmless me, my affiliates, officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of this Agreement
  • Your violation of applicable laws
  • Your use of the App
  • Your use of third-party content accessed through the App
  • Infringement of third-party rights
  • Your subscription or purchase transactions
  • Manual stations you add to your library

11. Term and Termination

11.1 Term

This Agreement begins when you first use the App and continues until terminated.

11.2 Termination by You

You may terminate this Agreement at any time by:

  • Deleting the App from all your devices
  • Ceasing all use of the App
  • Canceling any active subscriptions
  • Disabling iCloud sync (optional)

11.3 Termination by Me

I may terminate or suspend your access to the App immediately, without notice, if:

  • You violate this Agreement
  • You engage in fraudulent or illegal activity
  • I discontinue the App
  • Required by law

11.4 Effect of Termination

Upon termination:

  • Your license to use the App ends immediately
  • You must delete the App from all devices
  • Active subscriptions continue until their expiration (no refunds for remaining subscription periods)
  • Provisions that should survive (disclaimers, limitations, indemnification) remain in effect
  • Your data may be deleted from iCloud (at your discretion)

12. Changes to This Agreement

12.1 Right to Modify

I reserve the right to modify this Agreement at any time. Changes will be effective:

  • 30 days after notice for material changes
  • Immediately for non-material changes

12.2 Notice of Changes

I will notify you of changes by:

  • In-app notification
  • Updated "Last Updated" date at the top of this Agreement

12.3 Acceptance of Changes

Your continued use of the App after changes constitutes acceptance of the modified Agreement. If you do not agree to changes, you must stop using the App.


13. Governing Law and Jurisdiction

13.1 Governing Law

This Agreement is governed by the laws of Switzerland, without regard to conflict of law principles.

13.2 Jurisdiction

Any disputes arising from this Agreement shall be resolved in the courts of Frauenfeld, Switzerland.

13.3 EU Users

For users in the European Union:

  • Nothing in this Agreement affects your statutory rights under EU consumer protection laws
  • You may bring claims in your local courts
  • EU consumer protection laws apply where more favorable

13.4 UK Users

For users in the United Kingdom:

  • UK consumer protection laws apply
  • Nothing in this Agreement affects your statutory rights
  • You may bring claims in your local courts

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal proceedings, you agree to attempt to resolve disputes informally by contacting me at [email protected].

14.2 Mediation

If informal resolution fails, parties agree to attempt mediation before litigation.

14.3 Arbitration (Where Applicable)

Disputes may be resolved through binding arbitration in accordance with Swiss arbitration rules, except where prohibited by law.

14.4 Class Action Waiver

To the extent permitted by law, you agree to bring claims only in an individual capacity, not as part of a class action.


15. General Provisions

15.1 Entire Agreement

This Agreement, together with the Privacy Policy and Terms & Conditions, constitutes the entire agreement between you and me regarding the App.

15.2 Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions remain in full force and effect.

15.3 Waiver

My failure to enforce any provision does not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign or transfer this Agreement. I may assign this Agreement to an affiliate or successor without your consent.

15.5 No Third-Party Beneficiaries

This Agreement does not confer rights upon any third parties, except as expressly stated (e.g., Apple's rights under Section 1.3).

15.6 Force Majeure

I am not liable for failure to perform due to circumstances beyond my reasonable control (natural disasters, wars, strikes, government actions, pandemics, internet outages, cloud provider failures).

15.7 Export Compliance

You agree to comply with all export and import laws when using the App.

15.8 U.S. Government Rights

If you are a U.S. government entity, the App is "commercial computer software" and "commercial computer software documentation" as defined in FAR 12.212 and DFARS 227.7202.


16. Apple-Specific Terms

16.1 Acknowledgment

You acknowledge that:

  • This Agreement is between you and me, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide maintenance or support
  • Apple is not responsible for warranty claims
  • Apple is not responsible for product liability claims
  • Apple is not responsible for intellectual property infringement claims
  • Apple processes in-app purchases via StoreKit 2 but is not responsible for subscription management beyond payment processing

16.2 Third-Party Beneficiary

Apple is a third-party beneficiary of this Agreement and may enforce it against you.

17. Open Source Software

The App may include open-source software components, each subject to its own license terms. Such licenses are available within the App (Settings → Open Source Licenses) and take precedence over this Agreement with respect to those components.

Open-source components include (but are not limited to): MarkdownUI, ZIPFoundation, PostHog, libogg, libvorbis, libopus.


18. Beta Testing

If you participate in beta testing (via TestFlight or the Pladio Beta Testing & Bug Hunting Program):

  • Beta versions are provided "as is" without warranties
  • Features may change or be removed without notice
  • You agree not to disclose confidential information
  • Feedback provided may be used without compensation

20. Acknowledgment

BY CLICKING "ACCEPT", DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.

IF YOU DO NOT AGREE TO THIS AGREEMENT, DO NOT USE THE APP.


Definitions

"App": The Pladio software applications for iOS, iPadOS, macOS, tvOS, watchOS, and CarPlay, including all updates and associated services.

"Content": Radio streams, song metadata, lyrics, artwork, and other information provided through the App.

"Premium Features": Features available through in-app purchases or subscriptions via Apple StoreKit 2.

"Third-Party Services": External services integrated with the App (ACRCloud, Apple Music, MusixMatch, PostHog, Cloudflare, Supabase, etc.).

"User Content": Favorites, preferences, manual stations, and other data you create within the App.

"StoreKit 2": Apple's native in-app purchase and subscription framework. Used by Pladio to process all purchases and manage entitlements without any third-party subscription management provider.

"I", "Me", "My": Patrick Diezi / KREANIQS, the developer and operator of the App.

"You", "Your": The person or entity using the App.
